Agreement
These Terms of Use (“Terms”) govern your use of the Bimble mobile app and its widgets (“Bimble” or the “App”), provided by Baker Studios LLC, doing business as Baker Studios (“Baker Studios,” “we,” “us,” or “our”). By downloading, accessing, or using Bimble, you agree to these Terms. If you do not agree, do not use Bimble.
What Bimble does
Bimble is a personal countdown and journaling companion. You add dates you are looking forward to, and Pacer, an illustrated red panda, walks a trail toward them as the days pass. You can mark small daily things, write short notes and a letter to yourself, and build an illustrated village. Features may change as the App develops.
Eligibility
You must be legally permitted to use the App where you live. If you are under the age at which you can agree to these Terms, a parent or legal guardian must review and agree to them for you.
Your content
You keep all rights to what you write and add in Bimble. It is stored on your device, as described in the Bimble Privacy Policy. We do not receive it. You are responsible for keeping your own copy of anything important; Bimble lets you save your walk as a file at any time.
Price
Bimble is currently free to download and has no in-app purchases. If we ever offer paid features, the price and terms will be shown in the App before you buy, and purchases will be handled by Apple under Apple's terms.
Reminders and availability
Notification delivery, widgets, device backups, device settings, and operating-system behavior are outside our complete control. Reminders and widget updates can be delayed or unavailable. Dates and countdowns in Bimble are for personal encouragement and should not be relied on for travel, legal, medical, or other important deadlines.
Acceptable use
You may use Bimble only for lawful, personal purposes. You may not reverse engineer, copy, resell, or exploit Bimble except where applicable law expressly permits, or interfere with the App or the services it relies on.
Ownership
Bimble, including its software, characters, illustrations, music, sounds, text, and branding, is owned by or licensed to Baker Studios and protected by applicable intellectual-property laws. The Fredoka typeface is used under the SIL Open Font License. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to use Bimble on Apple devices you own or control, as permitted by Apple's usage rules.
Apple App Store terms
If you downloaded Bimble from Apple's App Store, Apple's applicable App Store terms and Standard End User License Agreement also apply. These Terms are between you and Baker Studios, not Apple. Apple has no obligation to provide maintenance or support for Bimble. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions.
Ending use
You may stop using Bimble at any time by deleting it from your devices. Sections that by their nature should survive, including ownership, disclaimers, limitations of liability, and governing law, will survive.
Disclaimers
To the fullest extent permitted by law, Bimble is provided “as is” and “as available.” We do not warrant that Bimble will be uninterrupted, error-free, or that any reminder, widget, or sync will occur at a particular time. Bimble is not a mental-health, medical, or other professional service. If you are struggling, please reach out to someone you trust or a local support service.
Limitation of liability
To the fullest extent permitted by law, Baker Studios and its members, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data or missed dates, arising from or related to Bimble. Nothing in these Terms excludes liability that cannot legally be excluded. Your local law may give you rights that these Terms cannot limit.
Changes to Bimble or these Terms
We may update or discontinue features and may revise these Terms as the App or legal requirements change. We will post revised Terms at this URL and update the date above. Continuing to use Bimble after revised Terms take effect means you accept them.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Nothing here prevents either party from using small-claims court or another remedy that cannot legally be waived.
